Serving as an Expert Witness
Our president has been engaged to provide forensic accounting services or serve as an expert witness in such matters as:
- Testifying in Geneva, Switzerland before a panel of judges of the United Nations Compensation Council as to the validity of damages claimed by claimants from various countries that had operations in Kuwait or Iraq after Iraq illegally invaded Kuwait.
- Investigated the embezzlement by the bank’s president who initiated fictitious transactions in unused customer lines of credit or construction loans. The former president admitted to the crime after seeing the evidence gathered and was eventually sentenced to prison.
- Served as an expert witness in a lawsuit initiated by minority shareholders against the majority shareholder who bought out the minority shareholders in a forced sale. Our client prevailed in this matter.
- Served as an expert witness for a bank who was being sued by a guarantor for a loan that asserted that he was enticed by the bank to serve as a guarantor for the loan. Therefore, he didn’t believe that he should have to repay the loan when the borrower defaulted. The matter was settled with only a small dollar amount conceded to the guarantor.
Toby has in excess of 30 years of experience working in or serving banks and credit unions. He has served well over 150 different financial institutions located throughout the country in his career. Toby has also served as a consultant to the FDIC and the Federal Housing Finance Agency that oversees Fannie Mae, Freddie Mac, and the Federal Home Loan Banking system.
